使用條款

歡迎來到我們的風起航手機移動應用程式 (下稱「WeRISE App」)。 WeRISE App由香港大學完全擁有和管理。我們將根據手機移動應用程式的使用條款和條件為您提供手機移動應用程式服務 (「使用條款」)。通過訪問或以其他方式下載、安裝或使用我們的手機移動應用程式，您承認您已閱讀並理解使用條款，並同意受這些使用條款的約束。如果您不同意這些使用條款，則應立即停止下載、安裝或使用WeRISE App。

 

風起航保留通過更新WeRISE App以整合新的使用條款而隨時更改這些使用條款的權利，恕不另行通知。您有責任定期查看我們在網上發佈的信息，以便及時了解此類更改。您繼續使用WeRISE App即表示您接受經修訂的使用條款。

 

下載、安裝、訪問或使用WeRISE App，您必須聲明（而我們有權據此依賴有關聲明）您年滿18歲或以上，並有構成具法律約束力合約的能力。

詞彙的涵義
「我們」乃對（提供服務的人士或公司的姓名或名稱）的提述，主要是指風起航。
「閣下」乃對我們向其提供服務的最終用戶或個人的提述。

被禁止的行為

您不得訪問或使用、或試圖訪問或使用WeRISE App提供的服務，以利用該服務於採取可能損害我們或任何第三方的任何行動、干擾服務的運作，或以違反任何適用法律的方式使用服務。

例如（但不限於），您不得︰

  • 以虛假姓名傳送任何訊息或資料，或以其他方式對您所傳送的材料與您的關聯或其來源作出失實陳述；

  • 提供不實、不準確、非最新或不完整的資料；

  • 傳送任何非法、中傷、誹謗、淫褻、欺詐、侵害未成年人、騷擾、威脅或仇恨性質的訊息或資料；

  • 傳輸任何侵犯或違反他人的知識產權（包括但不限於版權、商標權和廣播權）、私隱或公佈權的訊息或資料；

  • 未經事先明確許可，將透過WeRISE App提供的服務獲得的內容複製、轉發、分發、傳播、出售、出版、廣播或傳播予任何人；

  • 使用任何設備、軟件或例行程式干擾或試圖干擾WeRISE App提供的服務的正常運作；

  • 試圖對組成或以任何方式構成服務一部分的任何部分軟件進行修改、翻譯、破譯、反編譯、反彙編、反向工程或創建衍生作品；或

  • 從事限制或禁止任何人士使用或享用服務的任何其他行為，或我們全權判斷會使我們或我們的任何用戶、關聯方或任何其他第三方面臨任何法律責任、損害賠償，或任何類型的不利影響的任何其他行為。
     

我們保留權利，可隨時以任何理由或無須理由而暫停或終止您使用WeRISE App提供的服務的權限，恕不另行通知。

知識產權

WeRISE App提供的服務受香港特別行政區（「香港」）版權法保障。在香港版權法許可的最大範圍內，與WeRISE App提供的服務有關的所有版權由我們或我們的第三方特許人擁有。未經我們明確書面同意，您不得發佈、複製、分發、展示、演繹、編輯、改編、修改，或以其他方式利用服務的任何部分。

WeRISE App提供的服務概未有任何內容聲明或暗示根據香港任何版權法賦予您特許或權利。

免責條款

您從WeRISE App提供的服務中取得或獲得的資料僅供參考。手機應用程式提供的資料並不擬替代亦不能取代專業醫療意見、診斷或治療。請勿因您可能從手機應用程式中獲知或讀到的內容而忽視、迴避或延遲獲取合資格醫生或健康護理專業人員的醫療意見。請勿使用手機應用程式處理緊急醫療需要。

使用WeRISE App提供的服務的風險由您自行承擔。手機應用程式中所述或所載，或透過任何服務提供的任何內容概不擬亦不得被視為執業醫療服務或提供醫療護理服務。您須自行承擔倚賴WeRISE App提供的任何資料的風險。WeRISE App服務按「現狀」提供，不作任何類型明示或暗示的保證，包括但不限於對所有權、適銷性、對於特定目的適用性、未侵權或未違反其他權利的保證。我們不保證有關服務或連接至WeRISE App提供的服務或由WeRISE App提供的服務轉至的任何第三方網站的充分適用性、時效性、準確性、可能結果或完整性，亦不保證所提供的功能不會被中斷、無病毒或無錯誤。對於服務中包含的內容或連接至服務或從服務轉至的任何第三方網站中的任何錯誤或遺漏，我們明確表示概不負責。

​使用由或透過使用WeRISE App提供的資料概不會構成醫生與患者的關係。我們不對此中的專業資格、專業知識、工作質素或其他資料出任何明示或暗示的擔保、陳述或保證。

責任範圍

在任何情況下，即使已告知WeRISE可能造成此類損失，WeRISE均不承擔因您使用或無法使用WeRISE App而引起或與之相關的任何特殊、懲罰性、後果性、偶然、直接或間接的損害賠償（包括但不限於對人身或財產造成的損害、利潤損失，個人和/或業務中斷、個人和/或業務信息的損失，或任何其他金錢損失）。

彌償

您同意對WeRISE及其任何子公司、關聯公司、受託人、董事、高級職員、僱員、研究員和代理人進行賠償，並使之免受任何前述索賠、要求、損失、損壞、罰款、成本的損害，或因您使用或無法使用WeRISE App而產生或與之相關的各種或性質的費用。我們保留對根據本使用條款或與WeRISE App以及與解決方案或折衷方案進行的所有談判產生的任何要求、主張或行動進行專有辯護和控制的權利。您同意按照我們的要求與我們充分合作，以捍衛任何此類要求、索償、行動、解決或妥協談判。

連結網站

我們的移動應用程式中的若干連結（包括超連結）將引領閣下離開我們的移動應用程式。連結僅為閣下提供便利，任何連結不意味我們對連結網站、其營運商或其內容的支持或認可。我們不就我們的移動應用程式以外的任何網站內容負責。

版權和用戶責任

此移動應用程式提供的所有內容，包括但不限於WeRISE App中包含的任何圖像、照片、動畫、視頻、音頻、音樂、文本和小應用程式，以及WeRISE App中的印刷材料，均屬WeRISE所有。未經WeRISE的書面許可，不得修改、使用、複製或訪問此移動應用程式的內容用於任何目的和任何形式。 此手機應用程式的數據不得出售或用於構成任何盈利。

第三方流動程式

移動應用程式可能包含來自其他移動應用程式的第三方信息或連結，WeRISE不對任何不受WeRISE直接控制的第三方數據的操作和內容負責。 移動應用程式上顯示的連結僅供參考。 您對進入任何第三方移動應用程式負全部責任，WeRISE對任何使用或依賴任何第三方移動應用程式的信息概不負責。

用戶私隱
除非另有規定，否則使用此移動應用程式時提供的所有個人數據，將按照私隱政策聲明和適用的香港法律進行處理。您對使用移動應用程式時提供的信息負全部責任，並且您同意為我們提供準確和最新的信息。WeRISE將採取一切合理措施，嚴格遵守香港法律，對本流動應用程式中的任何個人信息保密。有關私隱的更多詳情，請參閱私隱政策聲明。

整個協議

這些使用條款是您與WeRISE之間關於WeRISE App和支持服務（如有）的完整協議，並取代有關WeRISE App或任何主題的所有先前的口頭或書面通訊、陳述或理解，或本使用條款涵蓋的事項。

即使WeRISE應用程式的支持服務的政策或程序有任何衝突的條款，也應以本使用條款為準。

第三方權利

雙方特此聲明，本協議中的任何內容均不授予，或意圖授予任何第三方任何利益或任何權利，以根據《合同（第三方權利）條例》（第623章）或任何其他外國條件執行本協議的任何條款具有類似效力的法規。

管限法律

本使用條款受香港特別行政區(「香港特區」）法律管限，並據香港法律解釋。就WeRISE App提供的服務產生，或與之相關而針對我們提出的任何申索或爭議，您同意受香港法院的專屬司法管轄權管轄。

雜項條文

倘本條款中任何條文被認定為不可強制執行，其餘條文的效力或可強制執行性將不受影響。

您同意本條款及您使用WeRISE App提供的服務概未在您我之間構成任何合資、合夥、僱傭或代理關係。

我們未強制執行本條款中的任何條文概不等如我們放棄在其後強制執行本條款中任何條款或條件的權利。

Terms of Use

Welcome to WeRISE App. WeRISE App is owned and managed fully by WeRISE under The University of Hong Kong. We will provide you services on our mobile application based on the terms and conditions of use of the mobile app (“Terms of Use”). By accessing or otherwise downloading, installing or using our mobile app, you acknowledge that you have read and understood the Terms of Use and agree to be bound, without limitation or retention, by these Terms of Use. If you do not agree with these Terms of use, you should cease downloading, installing or using the WeRISE App immediately.

WeRISE reserve the right to change these Terms of Use at any time without prior notice to you by updating the WeRISE App to incorporate the new terms of use. You are responsible for regularly reviewing information posted online to obtain timely notice of such changes. Your continued use of the WeRISE App constitutes your acceptance of the amended Terms of Use.

To download, install, access or use the WeRISE App, you must be aged 18 years or above and capable of forming a legally binding contract. 

Interpretation

“We”, “us” or “our” is a reference to the name of person or company providing the services, mainly referring to WeRISE. “You” or “your” is a reference to the end-user or and individual person to whom we are providing the services.

Prohibited Conduct

You may not access or use, or attempt to access or use, the services under WeRISE App to take any action that could harm us or any third party, interfere with the operation of the services, or use the services in a manner that violates any applicable laws.

For example, and without limitation, you may not:

  • transmit any message or information under a false name or otherwise misrepresent your affiliation or the origin of materials you transmit;

  • provide information that is untrue, inaccurate, not current, or incomplete;

  • transmit any message or information that is unlawful, libellous, defamatory, obscene, fraudulent, predatory of minors, harassing, threatening, or hateful;

  • transmit any message or information that infringes or violates the intellectual property (including without limitation copyright, trademark rights and broadcasting rights), privacy, or publicity rights of others;

  • reproduce, retransmit, distribute, disseminate, sell, publish, broadcast, or circulate the content received through the services under WeRISE App to anyone without prior express permission;

  • use any device, software, or routine to interfere or attempt to interfere with the proper working of the services under WeRISE App;

  • attempt to modify, translate, decipher, decompile, disassemble, reverse-engineer, or create derivative works of any of the software comprising or in any way making up a part of the services; or

  • ngage in any other conduct that restricts or inhibits any person from using or enjoying the services, or that, in our sole judgment, exposes us or any of our users, affiliates, or any other third party to any liability, damages, or detriment of any type.
     

We reserve the right to suspend or terminate your use of the services under WeRISE App for any or no reason at any time without notice.

Intellectual Property Rights

The services under WeRISE App are protected under the copyright laws of the Hong Kong Special Administrative Region (“Hong Kong”). All copyrights in connection with the services under WeRISE App are owned by us or our third-party licensors to the full extent permitted under copyright laws of Hong Kong. You are not allowed to publish, reproduce, distribute, display, perform, edit, adapt, modify, or otherwise exploit any part of the services without our express written consent.

Nothing stated or implied on the services under WeRISE App confers on you may license or right under any copyright laws of Hong Kong.

Disclaimer of Warranty

The information you obtain or receive from WeRISE App is for informational purposes only. THE INFORMATION PROVIDED IN THE APP IS NOT INTENDED AS A SUBSTITUTE FOR, NOR DOES IT REPLACE, PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. DO NOT DISREGARD, AVOID OR DELAY OBTAINING MEDICAL ADVICE FROM A QUALIFIED MEDICAL PRACTITIONER OR HEALTH CARE PROFESSIONAL BECAUSE OF SOMETHING YOU MAY HAVE KNOWN OR READ IN THE APP. DO NOT USE THE APP FOR EMERGENCY MEDICAL NEEDS.

Your use of the services under WeRISE App is at your own risk. NOTHING STATED OR POSTED IN THE WeRISE APP OR AVAILABLE THROUGH ANY SERVICES IS INTENDED TO BE, AND MUST NOT BE TAKEN TO BE, THE PRACTICE OF MEDICINE OR THE PROVISION OF MEDICAL CARE. If you rely on any of the Information provided by WeRISE App, you do so solely at your own risk. The services in WeRISE App are provided “as is” without warranties of any kind, either express or implied, including without limitation warranties of title, merchantability, fitness for a particular purpose, non-infringement, or other violation of rights. We do not warrant the adequacy, currency, accuracy, likely results, or completeness of the Services or any third-party sites linked to or from the services under WeRISE App, or that the functions provided will be uninterrupted, virus-free, or error-free. We expressly disclaim any liability for any errors or omissions in the content included in the services or any third-party sites linked to or from the services.

No medical practitioner-patient relationship is hereby created by using information provided by or through the use of WeRISE App. We make no guarantees, representations or warranties, whether expressed or implied, with respect to professional qualifications, expertise, quality of work or other information herein.

Limitation of Liability

In no event shall WeRISE be liable for special, punitive, consequential, incidental, direct or indirect damages whatsoever (including, without limitation, damages for any injury to person or property, damages for loss of profits, personal and/or business interruption, loss of personal and/or business information, or any other pecuniary loss) arising out of or related to your use or inability to use the WeRISE App, even if WeRISE has been advised of the possibility of such damages.

Indemnification

You agree to indemnify and hold WeRISE, and each of its subsidiaries, affiliates, trustees, directors, officers, employees, fellows and agents of any of the foregoing harmless  from and against any and all claim, demand, loss, damage, penalty, cost or expense of every kind or nature, based upon, arising out of or related to your use or inability to use the WeRISE App. We reserve the right to assume the exclusive defense and control of any demand, claim or action arising hereunder or in connection with the WeRISE App and all negotiations for settlement or compromise. You agree to fully cooperate with us in the defense of any such demand, claim, action, settlement or compromise negotiations, as requested by us.

Linked Websites

Certain links, including hypertext links, in our app will take you outside our app. Links are provided for your convenience and inclusion of any link does not imply endorsement or approval by us of the linked site, its operator or its content. We are not responsible for the content of any website outside our app.

Copyright and user liability

All contents provided by this mobile app, including but not limited to any images, photographs, animations, videos, audios, music, text, and “applets” incorporated into the WeRISE App and printed materials accompanying the WeRISE App are owned by WeRISE. Without the authorization of WeRISE by written approval, it is forbidden to modify, use, reproduce or access the contents of this mobile app for any purpose and in any form. The data for this mobile app must not be sold or used to make profits.

Third-party mobile app

The mobile app may contain third-party information or links from other mobile apps, WeRISE is not responsible for the operation and content of any third-party data that is not under WeRISE’s direct control. The links that appear on your mobile app are for convenience only. You are responsible for entering any third-party mobile applications, and WeRISE will not be responsible for any use or any reliance on information from any third-party mobile app.

User Privacy

Unless otherwise specified, all personal data provided when in use of this mobile application will be processed in accordance with the Privacy Policy Statement and Laws of applicable Hong Kong. You are solely responsible for the information you provide when using the WeRISE App, and you agree to provide us with accurate and up-to-date information. For a more detailed explanation on privacy, please also refer to the privacy section.

Entire Agreement

These Terms of Use is the entire agreement between you and WeRISE relating to the WeRISE App and the support services (if any), and supersedes all prior communications, representations or understandings, either oral or written, with respect to the WeRISE App or any subject matter covered by these Terms of Use.

The terms and conditions of these Terms of Use shall prevail notwithstanding any conflicting terms of policies or programs for support services of the WeRISE App (if any).

Rights of Third Parties

The Parties hereby declare that nothing in the Agreement confers or purports to confer on any third party any benefit or any right to enforce any term of this Agreement pursuant to the Contracts (Rights of Third Parties) Ordinance (Cap. 623) or any other foreign statute of similar effect. 

Governing law

These Terms of Use shall be governed by and construed in accordance with the laws of Hong Kong Special Administrative Region (“HKSAR”), and in respect of any disputes which may arise hereunder, you consent to the non-exclusive jurisdiction of the courts of Hong Kong.

Miscellaneous 

In the event any provision of these Terms of Use is held unenforceable, it will not affect the validity or enforceability of the remaining provisions.

You agree that no joint venture, partnership, employment or agency relationship exists between you and us as a result of these Terms of Use or your use of the services under WeRISE App.

​

Our failure to enforce any provisions of these Terms does not waive our right to subsequently enforce any terms or conditions of the Terms.
